The Damansara Damai Salary Dispute Case

This is part of the salary dispute case that involved 90 undocumented workers who stake claimed of the unpaid wages amounted to RM 152,041.20. ( RM: One hundred and fifty two thousand forty one and cents twenty only) In this Industrial Relation case it only cover the first batch of 54 workers that claim RM 123,050.00 ( RM : One hundred and twenty three thousand and fifty only )

The lawyer shall submit the remaining claim at Jabatan Tenaga Kerja Selangor as the follow up on the positive reception from the Ministry of Man Power.

The process of this case is also the confirmation of the misinformation of Dato Dr. Fong Chan Onn on February 16, 2005 about this salary dispute matter. There were no sub-contractor  absconded RM 500,000 from the 90 Damansara Damai workers thus Dato’ Dr. Fong Chan Onn had made a wrongful allegation without investigating the case. It is important for Human Resources Minister to retract his statement and apologies to the 90 workers involved in the case.

The 90 workers involved in the case has never been the sub-contractor of the jobs claims by Seri Mega Jaya as all the salary payment voucher clearly stated that the workers only received partial salary payment in the entire duration of the working period.

We urge Malaysia Government to investigate and ban the sub-contracting system in the construction and plantation sectors that involved foreign workers as the sub-contractor. The presence of the current sub-contracting system is main cause contributing to the influx of 700,000 the illegal plantation and construction workers in Malaysia.

We also urge the Malaysia Government to take seriously the importance of  the individual employment contracts to reduce unnecessary  disputes that waste of government resources to attend to the matters.
